It was already mentioned in the previous chapters why the emperor can’t kill or execute duke otien. The reason being that the otien duchy is part of the founding fathers and they have immunity meaning they cant be persecuted or punished if they haven’t committed treason. And as far as chloe coming forward as a witness she is already revered as a cursed doll if dhe started talking and doing stuff in front of everyone it would only make it easier to find fault in the emperor as the public has been calling him mentally ill. He may be a tyrant but it isnt easy continuing being one if everyone in his own empire is against him and finding flaws. So yes you do need evidence for this as you can’t execute a founding fathers family without evidence of treason.

If the doll says “Duke Otien is the instigator”, the Emperor can literally just say “off with his head” and announce he was the one who ordered the doll stolen.
If they ACTUALLY need evidence, Chloe can just get up and say “this guy kidnapped me and said the duke ordered it”. You do not need evidence for this. You do not need to leave a snake in your bed if you’re a tyrant.
